Terms and Conditions
Andrew Wicks Creative Ltd
The following Terms and Conditions of Service apply to all artwork, graphic design, print, and related services provided by Andrew Wicks Creative Ltd.
All design work is carried out by Andrew Wicks Creative Ltd with the understanding that the client agrees to abide by these Terms and Conditions as set out below.
Copyright and Ownership
Copyright and ownership of all graphic design work are retained by Andrew Wicks Creative Ltd, including concepts, ideas, proofs, and illustrations (unless specifically released in writing).
In such case, If artwork files are requested after the initial approval, a release fee will apply. Once this fee is paid, copyright and ownership will then reside with the customer.
Project Acceptance
At the time of proposal, Andrew Wicks Creative Ltd will provide the customer with a quotation by email as requested.
In this case, the client may send an official order in reply to the quotation, which confirms their acceptance of these Terms and Conditions.
Design Fees & Payment
Fees for design services will be clearly outlined in the written quotation provided to the customer.
Acceptance of the quotation indicates agreement to these Terms and Conditions.
The client will be asked to provide artwork sign-off before receiving the invoice and final files.
The fee must be paid within 30 days from the invoice date.
However, Accounts that remain unpaid after 30 days may incur an extra charge of 8% plus the Bank of England base rate per month on the outstanding balance.
Default
An account is considered in default if it remains unpaid for 30 days from the invoice date or after a returned cheque.
Andrew Wicks Creative Ltd reserves the right to remove the company’s or the client’s material from all computer systems until payment is made in full.
This includes all unpaid services, such as hosting, domain registration, search engine submissions, design and maintenance, subcontractors, printing, photography, and stock libraries.
However, removing such materials does not relieve the client of their payment obligation.
Customers whose accounts become default agree to pay Andrew Wicks Creative Ltd reasonable legal fees and third-party collection costs necessary to enforce these Terms and Conditions.
Copyrights and Trademarks
By supplying text, images, or other data to Andrew Wicks Creative Ltd for use in design work, the client confirms they hold the appropriate copyright and/or trademark permissions.
Ownership of these supplied materials remains with the customer or rightful owner.
Any artwork, images, or text created by Andrew Wicks Creative Ltd on behalf of the customer remain the property of the company and/or its suppliers.
In addition, by supplying materials, the client grants Andrew Wicks Creative Ltd permission to use them in the design process and to include completed designs in the company’s portfolio, unless agreed otherwise in writing.
Alterations
The customer agrees that any changes required beyond the quoted work, or after draft acceptance, will incur an additional charge.
Furthermore, Andrew Wicks Creative Ltd is not responsible for any amendments made by third parties before or after the design is published.
Rights of Refusal
Andrew Wicks Creative Ltd will not include any content deemed immoral, offensive, obscene, or illegal in its designs.
All advertising material must, therefore, comply with the standards of the relevant advertising authorities.
In addition, Andrew Wicks Creative Ltd reserves the right to refuse submitted material without providing a reason.
If any content later proves to breach these Terms and Conditions, the customer must allow its removal without penalty.
As a result, the company accepts no responsibility for such material being included in good faith.
Disclaimer
Andrew Wicks Creative Ltd provides all products and services without warranty, express or implied.
The company is not responsible for damages resulting from the use of its products or services.
This includes the loss or non-delivery of data, files, or materials, whatever the cause.
The customer agrees not to hold Andrew Wicks Creative Ltd liable for any loss or damage.
Any claim against Andrew Wicks Creative Ltd shall, therefore, be limited to the amount of fees paid by the customer.
Andrew Wicks Creative Ltd may use subcontractors, agents, or suppliers where required.
All work or services from third parties are consequently, subject to their own Terms and Conditions, which the client also agrees to respect.
General
These Terms and Conditions replace any previous versions issued in any form.
Andrew Wicks Creative Ltd reserves the right to change rates, policies, or Terms and Conditions at any time and without prior notice.
However, any updates will always be made available upon request.
